Terms of Service

1. Acceptance of Terms

By accessing or using the Laffstr website ("Platform") and associated services (including tools for comedians and comedy venues) you ("User", "you", "your") agree to these Terms of Service ("Terms"), which form a legally binding agreement between you and Laffstr (or "we", "us", "our"). If you do not agree to all of the Terms, you must not use the Platform.

2. Description of Service

We provide a software-as-a-service and online platform where:

Comedians may create and maintain profiles, upload and store personal/contact information, comedic material (jokes, bits, premises, sets), media (photos/videos), generate press releases, manage bookings, and contact venues.

Comedy venues may create profiles, browse comedian profiles, review materials, upload media, generate booking contracts, and enter into bookings with comedians.

We may update, modify, or discontinue features of the Platform at any time, with or without notice, at our sole discretion.

3. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Platform. By using the Platform, you represent and warrant that you are of legal age and that you have the right, authority, and capacity to enter into these Terms and use the Platform.

4. User Accounts, Profiles & Security

You will register for a user account and provide a valid email address (or other required credentials). You are responsible for maintaining the confidentiality of your account login and for all activity occurring under your account.

You agree to provide accurate, current, and complete information when registering and to update it as necessary.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

We are not liable for any loss or damage arising from your failure to comply with this Section.

5. User Content, Uploads & Licenses

"User Content" means any and all materials you upload to or submit through the Platform, including but not limited to: personal/contact information, comedic material (jokes, bits, premises, sets), photos, videos, press-release drafts, booking contract templates, and other data.

You retain all ownership rights in your User Content. By uploading or submitting User Content to the Platform you grant us (and our affiliates and service providers) a non-exclusive, worldwide, royalty-free, sublicensable right to host, store, display, reproduce, distribute, modify, translate, and create derivative works of your User Content as necessary to operate the Platform.

You represent and warrant that you own or have the necessary rights, licenses, consents, and permissions to use and upload the User Content and to grant the rights above. You further warrant that your User Content does not violate any law or infringe any third-party rights (including intellectual property, privacy, publicity).

We reserve the right (but have no obligation) to monitor, review, or remove any User Content, at our discretion and without liability to you.

6. Prohibited Conduct

You agree not to upload, post, transmit or otherwise make available any User Content or engage in any activity on the Platform that:

• Is unlawful, fraudulent, or violates any applicable law, regulation or third-party rights (intellectual property, privacy, publicity, etc.).
• Contains obscene, offensive, defamatory, harassing, hateful, violent, or otherwise objectionable material.
• Attempts to impersonate another person or entity or misrepresent your affiliation.
• Interferes with or disrupts the Platform, attempts to gain unauthorized access to the Platform or its systems, or circumvent security features.
• Uses the Platform to send unsolicited communications (spam), or for commercial solicitation outside the Platform's intended purposes.
• Uploads viruses, malware, or malicious code of any kind.

7. Bookings, Contracts & Commissions

Comedians and venues may use the Platform's tools to generate, review and execute booking contracts. You understand and agree that any agreement between a comedian and a venue is between you and the other party, not between you and us, unless expressly stated otherwise. We do not act as your agent in the negotiation or performance of any booking contract.

We may, in our discretion, charge service fees or commissions for certain transactions executed via the Platform (if applicable). Any such fees will be clearly disclosed.

We do not guarantee the availability, quality, performance, or reliability of any comedian, venue, or third-party engaged via the Platform. You agree to use your own judgment and conduct your own due diligence before entering into a booking.
